Terms of Service

⚠️ Please read these Terms of Service carefully before using FitRot. By downloading, installing, or using the FitRot application, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. About FitRot

FitRot ("App", "we", "us", or "our") is a screen time management application available exclusively on iOS. FitRot requires users to complete physical fitness movements in order to unlock additional screen time on their device. The App is operated by FitRot, Inc.

2. Eligibility & Age Requirements

FitRot is intended for users of all ages. However:

• Users under the age of 13 must have verifiable parental or guardian consent before using the App, in accordance with the Children's Online Privacy Protection Act (COPPA).
• Users between 13 and 17 represent that they have obtained parental or guardian permission to use the App and agree to these Terms.
• By using the App, you represent that you have the legal capacity to enter into this agreement, or that a parent or guardian has done so on your behalf.

3. Subscriptions & Payments

3.1 Subscription Plans

FitRot offers weekly, monthly, and annual subscription plans that unlock premium features within the App. Subscriptions are managed through Apple's App Store and are subject to Apple's payment terms.

3.2 Billing & Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Your Apple ID account will be charged upon confirmation of purchase and at the start of each renewal period.
• Subscription prices may vary by region and are displayed at the point of purchase.

3.3 Cancellation

• You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions).
• Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

3.4 Free Trials

• If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial period ends.

3.5 Refunds

• All refund requests are handled by Apple and subject to Apple's refund policy. FitRot does not directly process refunds.

3.6 Superwall

FitRot uses Superwall to manage and display subscription paywalls and in-app purchase flows. Superwall may collect certain anonymized data about how users interact with subscription prompts to optimize the in-app purchase experience. For more information, see Superwall's Privacy Policy.

4. Health & Biometric Data

4.1 Data We Collect

To facilitate fitness movement verification and personalize your experience, FitRot may collect the following health and biometric data:

• Body weight
• Heart rate (via Apple HealthKit or device sensors)
• Movement and activity data (used to verify completed fitness exercises)
• Fitness exercise completion records

4.2 Apple HealthKit

If you grant permission, FitRot may read from or write to Apple HealthKit. Health data accessed through HealthKit:

• Will never be sold to third parties.
• Will not be shared with third-party analytics, advertising, or data brokers.
• Will only be used to provide core App functionality.
• Is governed by Apple's HealthKit terms in addition to these Terms.

4.3 Fitness Movement Verification

FitRot uses your device's camera or motion sensors to detect and verify physical fitness movements. This data is processed to confirm exercise completion and is not stored beyond what is necessary to unlock your screen time.

4.4 Accuracy Disclaimer

FitRot is not a medical device. Health and biometric data collected by the App should not be relied upon for medical diagnosis, treatment, or clinical decision-making. Always consult a qualified healthcare professional before starting a new exercise program.

5. Third-Party Services & Data Sharing

FitRot integrates third-party services to analyze app usage and attribute marketing. Each of these services has its own privacy policy and data practices.

5.1 Mixpanel (Analytics)

We use Mixpanel to collect anonymized analytics about how users interact with FitRot — such as feature usage, session length, and engagement patterns. This data helps us improve the App experience.

• Mixpanel may collect device identifiers, usage events, and app interaction data.
• Data is collected under Mixpanel's standard privacy practices.
• You can opt out of Mixpanel analytics by adjusting your privacy settings within the App or by visiting Mixpanel's Opt-Out page.

5.2 AppsFlyer (Attribution & Marketing)

We use AppsFlyer to measure the effectiveness of our marketing campaigns and understand how users discover FitRot. AppsFlyer collects data to attribute app installs and user actions to marketing sources.

• AppsFlyer may collect device identifiers (e.g., IDFA with your consent on iOS), IP address, and app events.
• FitRot does not share HealthKit data or biometric data with AppsFlyer.
• You can opt out of AppsFlyer tracking via Apple's App Tracking Transparency (ATT) prompt, or at AppsFlyer's Privacy Center.

5.3 Apple App Tracking Transparency (ATT)

In compliance with Apple's ATT framework, FitRot will request your permission before tracking your data across apps and websites owned by other companies. You may change your tracking preferences at any time in Settings → Privacy & Security → Tracking.

6. User Content & Conduct

By using FitRot, you agree not to:

• Attempt to circumvent, spoof, or otherwise fraudulently satisfy the fitness movement requirements to unlock screen time.
• Reverse-engineer, decompile, or tamper with the App or its underlying code.
• Use the App in any way that violates applicable laws or regulations.
• Impersonate another person or create a false identity within the App.
• Upload or transmit malicious code, viruses, or harmful data.

FitRot reserves the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these Terms.

7. Intellectual Property

All content, design, code, branding, and technology in FitRot — including the name "FitRot," logo, user interface, and underlying software — are owned by or licensed to FitRot, Inc. and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use FitRot for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, or create derivative works from any part of FitRot without our express written permission.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for full details on how we collect, use, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

Key privacy highlights:

• We do not sell your personal data to third parties.
• Health and biometric data is never shared with advertisers.
• Analytics data (Mixpanel) and attribution data (AppsFlyer) are collected in anonymized or pseudonymized form.
• You may request deletion of your data at any time by contacting us at privacy@fitrot.app.

9. Disclaimers

9.1 No Medical Advice

FitRot is a wellness and productivity tool, not a medical device. Nothing in the App constitutes medical advice. Consult your doctor before beginning any fitness program.

9.2 "As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability.

9.3 Fitness Risks

Physical exercise involves inherent risks. FitRot is not responsible for any injury, illness, or harm that may result from performing fitness movements required by the App. Use the App at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FitRot, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of data or device functionality
• Physical injury from exercise activities
• Unauthorized access to your account
• Issues arising from third-party services (Mixpanel, AppsFlyer, Superwall, Apple)

In no event shall FitRot's total liability to you exceed the amount you paid for your subscription in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless FitRot, Inc. and its affiliates, officers, directors, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of the App
• Your breach of these Terms
• Your violation of any third-party rights
• Any inaccurate health or biometric data you provide

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a formal claim, you agree to first contact us at legal@fitrot.app to attempt to resolve the dispute informally. We will try to resolve the issue within 30 days.

12.3 Arbitration

If informal resolution fails, disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), except for claims that may be brought in small claims court. Class action lawsuits and class-wide arbitration are not permitted.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via in-app notification or email (if provided).

Your continued use of FitRot after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your access to FitRot at any time, with or without notice, for any reason including violation of these Terms. Upon termination:

• Your license to use the App ends immediately.
• Active subscriptions will not be automatically refunded (cancellation must be done through Apple).
• Sections 7, 9, 10, 11, and 12 survive termination.
